The U.K. Corporate Manslaughter Act, scheduled to take effect April 6, is intended to provide a more effective means to prosecute corporations for “corporate manslaughter” in England, Wales and Northern Ireland and “corporate homicide” in Scotland. The law toughens businesses’ “duty of care” responsibilities toward their employees and provides penalties for corporations that fail to properly manage the health and safety of their employees. The Act encompasses any work-related deaths that occur in the U.K., regardless of whether the employer is U.K. based. As corporate travel leaves many employers potentially liable under the law, iJET advises all professionals responsible for upholding a company’s duty of care to assess their corporate travel policies and practices.
